Thank you for choosing to book with us. Any reference to either ‘us’ or ‘we’ or ‘owners’ in these booking conditions refers to Urban Boutique Apartment, ‘you’ or ‘your’ or ‘guest’ or ‘party lead-er’ are references to the person making the booking and all members of the holiday party. So that you understand the basis of the contract between you and us when you book your accom-modation, we have laid out as clearly as possible, the conditions on which your booking is made. Nothing in these conditions affects your normal statutory rights. Please read our terms and con-ditions of booking below:

Your booking

You must be at least 30 years old when you book your accommodation. Your booking is made as a consumer and you acknowledge that no liability can be accepted for any business losses suf-fered or incurred by you. When we issue our written confirmation to you we enter into a contract with you, the party leader, which is subject to these booking conditions. Any disputes or queries will be between the party leader and the owners. The party leader will assume responsibility for the whole party and the compliance with these rules of all party members. We have the right to refuse any booking prior to the issue of our written confirmation, and if we do this we will tell you in writing and promptly refund any money you have paid us. When your confirmation is received, the details must be checked carefully. If anything is not correct you should tell us immediately.

A deposit of 25 % of the booking price is payable immediately, at this point your booking be-comes binding, subject to the approval of these terms and conditions. These are being sent with your deposit, and are on our website and if you are not happy with any part of these terms and conditions, your deposit will be refunded in full within 14 days. No bookings are valid until confirmed by us in writing. We reserve the right to accept or refuse bookings. The booking con-ditions will apply to all confirmed bookings. Please take your time to read these conditions.

Number of Occupants

The number of persons occupying the property must not exceed the maximum number stipulat-ed in our property descriptions maximum of 10 people. We reserve the right to refuse entry to the entire party if this condition is not observed. This must be adhered to and before your book-ing is confirmed, the person who made the booking must complete the Guest Information Form which is automatically sent to their email once they select ‘book’ on the website. Parties must not exceed the numbers specified and the owner reserves the right to ask customers to vacate if this is abused. Please make sure that the accommodation you book meets your requirements. We do not accept any loud parties.

Paying for your accommodation

A deposit of 25% of the booking price is payable immediately, at this point your booking be-comes binding and the guest is responsible for the full balance of the cost of the holiday. The balance of the booking cost must be received by us no later than 60 days before your arrival date. We reserve the right to cancel the booking if full payment has not been received by 60 days prior to your arrival. If you book less than 60 days before the arrival date, payment of the total cost is due straightaway. All payments are preferred by bank transfer.

We don’t ask for a breakage deposit but the lead booker must complete our Guest Verification Process with SuperHog who are an insurance company. Your booking is not confirmed until this has been completed.

Cancellation of the booking by you the guest 

We do understand there are circumstances when cancellations are required. If you need to cancel the booking, you must contact us as soon as possible by email. We accept cancellations up to 60 days before arrival.

The 25% booking deposit is a legal contract and non-refundable. However, we will make every effort to re-let the property once formal cancellation has been received and if we are able to re-let at the same price for the same dates, the deposit will be refunded to you.

We strongly recommend you take out travel insurance against cancellation due to adverse weather (and your inability to reach the property), ill-health or bereavement etc. If we have the availability and your stay is moved within one month of the original arrival date due to weather, ill-health or bereavement, we will honour the change of dates and any surplus charge due to moving from low-peak season for eg, will apply.

For a full refund (75%), you may cancel up to, at least 60 full days before the check-in time minus the initial 25% deposit. (This will be refunded separately to you if we manage to re let the dates you cancelled at the same price).

If you cancel less than 60 days before check-in, there will be no refund (if we manage to re let the same dates at the same price we will refund the 75%).

Cancellation of booking by us / Disruption to your stay

We have the right to cancel your booking in advance and you will be refunded the full amount of the booking. We would only cancel your holiday if your accommodation was unavailable (“una-vailability” does not extend to your inability to reach the property, due to adverse weather for example) for reasons beyond our control. In this circumstance, we would refund all monies paid by you for the holiday. Our liability would not extend beyond this refund.

Except where otherwise expressly stated in these conditions, Urban Boutique Apartment shall not be liable for any changes, cancellations, effect on your holiday, loss or damage suffered by you or for any failure by Urban Boutique Apartment to properly perform any of their respective obligations to you which is due to any event(s) or circumstance(s) beyond the reasonable con-trol of Urban Boutique Apartment (ie “force majeure”). By way of example, force majeure in-cludes fire, flood, power grid supply issues, exceptional weather conditions (ie your inability to reach the property due to snow), epidemics, destruction or damage of the property by any cause (other than negligence of Urban Boutique Apartment) and all similar situations.

Covid/Coronavirus/Pandemic Cancellation Policy

Should we be forced to close by government restrictions we will refund you in full or move your stay with us to another date.

We strongly advise you to take out travel insurance to cover your group against Covid and illness in general. We can’t accommodate guests who are told to isolate. Please do not travel if you have any Covid related symptoms.

Damage to property and the Refundable Damage Deposit

You are responsible to the owner for the actual costs of any breakage or damage in or to the ac-commodation, along with any additional costs that may result, which are caused by you or your party. No repairs of any kind to the property or contents must be attempted by you or your par-ty. Any damage must be reported immediately to the owners. Please let us know about any problem with any appliance or fixture or fitting as soon as possible and we will ensure that, with-in a reasonable time, this is repaired or alternative arrangements are made. If this is something we cannot fix whilst you are staying at the property and we believe the breakage or damage will actually impact your experience, then we are be able to consider a gesture of apology. Can we please ask that you refrain from affixing any decorations direct to walls to avoid marking the walls.

Our housekeeper takes pictures before and after every stay, of items of value and the condition of furnishings like the sofas, beds, mattresses, tables and chairs, art work etc. These photos are dated and timed to ensure any guest, where we have a discrepancy of damage caused intention-al or non-intentionally, can see the photos relate directly to their stay. This is not to offend but to ensure a smooth resolution for all parties is achieved as soon after your stay.

Accidents, injury, and personal property

The owners shall have no liability to you for the death or personal injury to you or any member of your party. Visitors are asked to take care at all times while on our property. Parents in particular are asked to ensure that all children are safe, accompanied by a responsible adult and not left unattended. We do not accept responsibility or liability for injury or damage to and loss of guests property, cars and contents and you agree to indemnify and hold us harmless from and against all actions, claims, costs and proceedings (including reasonable legal fees incurred in de-fending the same) arising from your acts or omissions (and those in your party) while on our property. In the event of guest misbehaviour or other necessary cause, we reserve the right to terminate the let without any refund of letting monies.

Website and advertisements

The owners aim to ensure that the information and descriptions provided are accurately con-veyed on the official website (www.urbanboutiqueapartment.co.uk) and any authorised third-party websites or advertisements. There may be small differences between the actual accom-modation and its description as we are always seeking to improve services and facilities. Occa-sionally, problems mean that some facilities or services become unavailable, and if this is the case, we will tell you as soon as reasonably practical after we have been made aware of the situa-tion. Similarly, we cannot accept responsibility for any changes or closures to local area ameni-ties or attractions mentioned on the website or advertised elsewhere. There are many unauthor-ised websites listing holiday cottages. We cannot accept responsibility for the descriptions on these sites.

Arrival and departure

Your accommodation will be available to you at 3pm on the start date of your holiday and you must leave by 10am on the last day. The period before and after your stay is probably booked by other guests, so please respect our check in and departure times so we have enough time to prepare for the next group (the result of your late departure could incur charges as a result of housekeeping staff being prevented from accessing the property at the agreed departure time).

You must allow the owner or any representative of the owner access to the property at any rea-sonable time during your stay. Your right to occupy the property is limited to a right of occupa-tion for holiday purposes and such right shall terminate at 10.00 am on the scheduled date of the completion of the holiday.

We are very flexible home owners and want you to have as much time as possible at the property should you choose. We may not be able to be flexible on your check out time as we have to work around the house keeper’s schedules but we may be flexible on your check in time, especially if the house has been prepared the day before for you. Please do ask us and if we can allow this, we will confirm this in writing to you.

Bed linen and towels

Bed linen and bath towels are provided and included in the price of the holiday.

If you are staying at Urban Boutique Apartment for 2 weeks, we will provide you with a change of linen for all beds being used and clean towels for all original guests.

Cleaning on departure

Although we do not expect the property to be fully cleaned, we would kindly ask you to-

  • Leave used towels in a pile in the shower.
  • Leave the beds we will take care of the bed stripping.
  • Empty the bins and put all rubbish in the correct bins provided outside.
  • Remove any opened and perishable food from the kitchen fridge.
  • Wash and put away any dirty dishes and/or load the dishwasher and start a clean cycle.
  • Close windows and lock the doors.
  • Put any furniture back as you found it

We reserve the right to make a charge if our home is left in an excessively dirty condition.

Your responsibilities

For the whole period included within your booking, you will be responsible for the property and will be expected to take all reasonable care of it.

Smoking

Smoking is strictly prohibited Inside and anywhere on the Urban Boutique Apartment property. We have very sensitive smoke alarms in every room that are wired together and are therefore linked. We reserve the right to seek compensation (including consequential loss) for any damage and additional costs of cleaning (such as blinds etc), or fire alarm activations caused by a guest smoking inside the property. We will charge £1000 to professionally remove the smell of smoke from the property, prior to the arrival of the next guest who subsequently demands compensa-tion from ourselves. Note we also do not permit the use of candles, or any flammable materials both from a fire risk point of view and to avoid any alarm activations that may result in the call out of the fire service.

Amenities

The heating / boiler system is controlled by a Digital Nest Thermostat. Instrutions will be pro-vided via our online welcome book.

Fireworks / Music / BBQ’s

Use of fireworks/lanterns/BBQ’s are not permitted under any circumstances at any time.
The use of any music system is not permitted under any circumstances at any time. We want you to enjoy yourselves and relax, but please respect that we have neighbours.

As previously mentioned we do not permit the use of candles or any flammable materials.

Problems & Complaints

Every effort has been made to ensure that you have an enjoyable and memorable holiday. If however, you have any problem or cause for complaint it is essential that you contact us imme-diately to give us the chance to resolve it. It is important that this is done whilst you are still at the property so that an on-the-spot investigation can be made if necessary and remedial action taken if required.

If this isn’t possible, we will try to resolve the issue over the phone with you on this number 07951 495 519 .

In no circumstances will compensation be considered for complaints raised after the holiday has ended, when the holidaymakers have denied the owners the opportunity of investigating the complaint and endeavouring to remedy matters during the holiday. We value your custom and want you to return.

Lost Property

Please contact us as soon as possible if you think you have left any personal items in a property after your departure. Should you wish your items to be returned, we will happily do so but the postage must be paid in advance by you. In the event of us finding any property, we will contact you and if we have not had a response from you within 28 days, we will dispose of the item, based on their condition, as we see fit. But we will try to make contact with you after you return home, if any items are found by house keeping.

Data

All electronic data transferred pursuant to these terms and conditions remains the property of the owners or their agents and may not be replicated in part or whole without the owners prior written permission. Electronic data will not be preserved indefinitely by the owners.

Changes to Terms

We may revise these terms from time to time.

If we revise these terms prior to your arrival date, we will email you with a new copy. You can choose to cancel the booking agreement, if any new terms are no longer suitable to you.

Rights

Urban Boutique Apartment may transfer their rights and obligations under these terms to an-other organisation, and will notify you in writing if this happens but this will not affect your rights or Urban Boutique Apartment obligations under these terms.

Breach of Contract

  • If there is a breach of any of these clauses by the Guest or any of their party, the Owners reserves the right to re-enter the property and end the holiday and ask the Guest and their party to leave.
  • If there is a breach of any of these conditions by the Owners, then the Guests have the right to end the holiday and leave.
  • Ending the holiday by the Owner or the Guest does not affect that party’s other rights and remedies.
  • Each of the paragraphs of these terms operate separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in force.

Validity Clause

If any term or provision in these booking terms and conditions is found by any court, tribunal or administrative body or competent jurisdiction to be wholly or partly illegal, invalid, void, voida-ble, unenforceable or unreasonable it shall to the extent of such illegality, invalidity, voidness or unreasonableness be deemed to be severable and the remaining provisions of the booking con-ditions and the remainder of such provision shall continue in full force and effect.

Jurisdiction and Governing Law

These terms are governed by English Law. You agree to submit to non-exclusive jurisdiction of the English Courts. However, if you are a resident of Northern Ireland, you may also bring pro-ceedings in Northern Ireland and if you are a resident in Scotland you may also bring proceedings in Scotland.

Please note that these booking conditions supersede all previous issues.
